Shri P.B.Khedkar, Head Constable of Newasa police station, who is said to be investigating officer of Crime No. 162 of 2008 is instructing the learned Additional Public Prosecutor today.

It is submitted that as on today no charge sheet could be filed by the police in connection with the complaint filed. Considering the allegations made in the complaint, we find that the investigation ought to have been completed much earlier and within a reasonable time. Delay in final outcome of the investigation would frustrate the very purpose of investigation into a crime. The confidence of the people at large gets shaken if the incidents of the nature as alleged in the complaint are not investigated finally within a reasonable time frame.

On instructions Shri Kaldate, learned A.P.P. submits that within a week’s time charge sheet would be filed as the police have recorded statements of witnesses and completed necessary investigation.

We would take this opportunity to indicate to the higher authorities of the police department that appropriate survey shall be conducted of complaints, wherein allegations made could be investigated within a short period and if such complaints are still pending, adequate steps should be taken to conclude the investigation, which would provide a positive signal to the society and even curb unnecessary litigation on that score.

We accept the statement of learned A.P.P. Shri Kaldate.

We express no opinion on the merits of the allegations made by the petitioner.

The petition stands disposed of. Copy of this order be forwarded to the Superintendent of Police, Ahmednagar. Authenticated copy be provided to the learned A.P.P. The parties to act on the authenticated copy.
