The petitioners are virtually asking us to sit in appeal over judgment and
order dated 13/8/08 passed by the Division Bench of this court to which one of
us (A. A. Sayed, J.) is a party. It is not possible for us to do so.
We are informed that survey is already conducted as directed by this court. Needless to say that, if any remedy is open to the petitioners to challenge
the survey, they may do so in accordance with law.
We, however, make it clear that we, have not expressed any opinion on
the merits of the petitioners’ case.
Petition is disposed of.
