 Rule. By consent, rule is made returnable and

 2. The claim of Respondent no.4 has been agreed to
 be settled in the sum of Rs.6,70,000/- as and by way
 of full and final settlement.

 3. The learned counsel appearing on behalf of
 Respondent no.4 states that the Petitioner in
 Criminal Writ Petition No.2100 of 2003 and
 Respondent no.4 herein, who is Respondent no.1 in
 the said Criminal Writ Petition, have agreed subject
 to the order of the Court that a sum of
 Rs.3,43,000/- deposited in the same Criminal Writ
 Petition will be handed over to/withdrawn by
 Respondent no.4 herein i.e. Respondent no.1
 therein.

 Further, a pay order in the sum of Rs.3,27,000/-
 bearing no.480129 dated 5.2.2009, drawn on Bank of
 Baroda, will also be handed over as part of the
 terms in the said Criminal Writ Petition. Thus, the
 claim of Respondent no.4 herein will stand fully
 satisfied.

 I am further informed that the Criminal Writ
 Petition is on board today.

 4. In the circumstances, it is agreed that the
 amount of Rs.4,55,000/- deposited by the Petitioner
 in the present Writ Petition with Respondent no.1 is
 now no longer required to be retained by Respondent
 no.1. Respondent no.1 shall therefore hand over the
 same with interest thereon, if any, to the
 Petitioner on or before 16.2.2009.

 5. Writ Petition is disposed of accordingly. The
 Chamber Summons also stands disposed of.

 6. Liberty to apply in case of difficulty.

 7. All parties to act on an ordinary copy of this
 order duly authenticated by the Personal Assistant
