 1. This Writ Petition ought not to have been

 filed. The only statement made in the Writ Petition

 is that the appeal was dismissed as not maintainable.
 I therefore, sent for an order from the Small Causes

 Court. The order has dismissed the appeal for
 non-compliance with the provisions of Section
 217(2)(b) of the B.M.C. Act as the Petitioner had not
 first adopted the procedure under Section 163 of the
 B.M.C. Act. These facts ought to have been disclosed

 in the Writ Petition itself. The Petitioner must
 first comply with the provisions of Section 163 of the
 B.M.C. Act.

 2. In the circumstances, the Writ Petition is
 dismissed.
