Learned counsel for the petitioners states that 5 gunthas out of
the land on which the petitioners’ residential colony is situate has been allotted by the Sub Divisional Officer (S.D.O.) of Alibag for cremation ground. In this petition the petitioners have sought a
direction to the respondents to prevent / prohibit cremation of human bodies within the residential colony of the petitioners. Learned counsel states that since the land itself has been now allotted for cremation ground, the petitioners want to challenge the said order of allotment. He states that he has, therefore, instructions to withdraw the petition with liberty to challenge the order of allotment.
