This is a petition under Article 226 of the
Constitution of India by which the petitioner has
prayed for issuance of a writ of mandamus for
directing respondent no.2 to decide the complaint
filed by the petitioner dated 30.7.2007 in accordance
with the Govt. decision dated 9.1.1980 and 20.8.1996.
The petitioner has also prayed for cancellation of the
FL-I licence of respondent no.3.

2.It appears that the petitioner, relying upon the
policy of the Government that a person already holding
a licence cannot be issued with a second licence,
complained to the authorities against grant of licence
to the respondent no.3. It appears that the complaint
of the petitioner went unheeded and, therefore, the
petitioner has filed the present petition. At the
time of admission of the petition the Court directed

learned Counsel for the petitioner to place on record
the copy of the order passed by the Division Bench of
this Court in Writ Petition No.654 of 1980. The
learned Counsel for the petitioner has tendered before
us the copy of the judgment rendered in Writ Petition
No.654 of 1980 and other connected petitions. On
perusal of the aforesaid judgment it appears that the
Division Bench struck down the policy of the
Government in not issuing the two licenses to an
individual. In the light of the said judgment of the
Division Bench of this Court, according to us the
reliefs which are sought for by the petitioner in this
petition cannot be granted to him.

3.In the light of that, therefore, there is no
merit in the petition and the petition is, therefore,
summarily dismissed with no costs.
