1. On 4th December, 2008 A.M.Khanwilkar, J passed the
following order :
By way of last opportunity, petitioners
are granted time to produce acknowledgment or
endorsement, as the case may be, indicative
of attempt to serve the statutory notice on
the respondents by the postal authority.
That be produced on or before 17th December,
2008 along with affidavit, failing which
petition to stand dismissed for non
prosecution.
If steps are taken in time, petition be
listed on 18th December, 2008.
2. The acknowledgment or endorsement has not been
produced. The consequence of thisis provided in the
order itself. In other words, the petition stands
dismissed by force of the order dated 4th December
2008 itself. In view of this order, it is not open
for me to consider any other submissions.
3. Company petition is accordingly dismissed.

4. In view thereof, Official Liquidator shall stand
discharged. The operation of this order is stayed for
a period of eight weeks from today.
