1.In this petition the parties have
tendered the consent terms dated 30th July,
2009 which are taken on record and marked �X�
for identification. The consent terms are
signed by the petitioner as well as the Vice
President of the respondent Company and their
respective advocates. The company petition
is, therefore, disposed of in terms of the
consent terms �X�. It is clarified that the
said dismissal is conditional i.e. in the

event of any two defaults on the part of the
respondent Company in making the payment to
the petitioner as set out in the consent
terms the petition shall automatically stand
admitted without recourse to Court and all
consequences would follow.
