1. Mr.Sen, learned counsel appearing for defendant
Nos.1 to 3, after taking instructions, makes a statement
that, as far as the schedule of the documents of which

inspection is sought, the advocate for the plaintiff
will be given inspection of the documents at Sr.Nos.3
and 4, so also zerox copies on payment of usual charges.
As far as the documents at Sr.Nos.1 and 5, those
documents are orders of this Court and no inspection
need be given. As far as document at Sr.Nos.2 and 6 are
concerned, copies of the same would be provided if
already not provided and Mr.Sen, after taking
instructions makes a statement that the documents which
are referred to in the reply but not relied upon, need
not be given inspection. However, if defendants 1, 2
and 3 rely on some documents in reply, then, they will
provide inspection of the originals and so also copies
thereof.
2. Chamber Summons No.262 of 2009 is disposed of in the
above terms.
3. Equally, it is agreed that the plaintiff’s advocate
will grant inspection of documents to defendants relied
upon by the plaintiff. This exercise to be completed by
2/3/2009.
4. Post the Notice of Motion No.4309 of 2008 for
hearing and final disposal on 16.3.2009.
