The petitioner-claimant has filed this petition under Section 14 of the Arbitration and Conciliation Act, 1996 (for short “The Act”), basically, with prayer to direct the sole arbitrator to dispose of arbitration proceeding expeditiously. Apart from appointment of an Arbitrator, as the arbitration proceeding is pending since 2005 which arose in view of work of extensive repairs and allied works to building of respondents.

First Arbitrator was appointed on 18th May 2005, then on 23rd March 2007 and now as stated on 12th January 2009. It appears that for one reason or other, the Arbitrator could not proceed with the matter. It is desirable specially considering the facts and circumstances, the said proceeding should be disposed of within reasonable time. Now, in view of the facts and as an Arbitrator has already been appointed, and issues are already framed, the present petition can be disposed of with direction that the learned Arbitrator, if possible, may dispose of this arbitration proceeding preferably within six months. Both the parties to cooperate accordingly.

Resultantly, petition is disposed of accordingly.
