In response to the same the learned APP has fairly submitted that it has been revealed in the investigation that the applicant is staying at some other place and is not residing in the premises wherein the electric meter is fitted. Thus prima facie the applicant does not appear to be guilty of the offence. In the result, I direct that in the event of arrest of the applicant in LAC No. 1062/09 registered with Ghatkopar Police station, for offence punishable under section 135 of Indian Electiricity Act and under section 379 of IPC, the applicant shall be released on bail on executing personal bond in the sum of Rs. 5000/- with one or two sureties in the like amount. The applicant shall abide by the conditions stipulated under section 438(2) of Cr.p.C. Application is disposed of.
