The complainant is a practicing advocate and on whose complaint C.R. No. 227/09 came to be registered at Andheri Police station for offence under section 341, 395, 397 read with 34 of IPC. The present application is moved by the husband and wife who are the applicants in this application. The parties have resolved the dispute by entering into a settlement out of court and consent terms arrived at between the applicants and the complainant are placed on record. Under the said consent terms the applicants have agreed to pay a sum of Rs.one lac to Kirtikar library at High Court by way of donation on behalf of the complainant and has also agreed to pay a sum of Rs. 50,000/- to the Bombay City Civil Court Bar Association yet again, for and on

behalf of the complainant. The applicants were also tendered unconditional apology which the complainant has accepted. In view of the settlement arrived at between the parties, the present application is not opposed and the applicants and/or the complainant would be taking appropriate proceedings for quashing or otherwise. The consent terms are taken on record and marked as `X’ for identification. In the result the application is allowed and it is ordered that in the event of arrest of the present applicants or any of them, the applicant shall be released on bail on furnishing personal bond in the sum o Rs. 5000/- with one or two sureties in the like amount. The applicants shall abide by the conditions set out in sec. 438(2) of Cr.P.C. Application is disposed of. The Associations are free to act on the understanding arrived at between the parties.
