The learned APP had made a statement on the last date that the applicant has been arrested and has already been released on bail rendering the present application infructuous. With a view to ascertain the correctness of the said statement, time was granted to the applicant. The learned counsel for the applicant inform the court that after the arrest the applicant has been released on bail, however the arrest has been in breach of the order passed by this court. Thus the counsel for the applicant submits that the applicant proposes to initiate proceedings under the Contempt of Courts Act. Be it as it may, the present application does not survive and hence the application is disposed of as infructuous. The learned counsel further submits that the contempt application moved in these proceedings is not being pressed and seeks liberty to file appropriate proceedings under the Contempt of Courts Act. Hence the said application is dismissed with liberty as prayed for.
