2.The applicant, convicted for the offence punishable

under Sections 489-B and 489-C read with 34 of the
I.P.C., is sentenced to suffer R.I.,for 3 years and fine
of Rs. 5,000/- and in default to suffer R.I., for six

months on both counts, has preferred the appeal before
this Court which is pending. The applicant has moved the
present application for bail. Reportedly, she was
released on bail during the trial and at present she is
on temporary bail granted by the Trial Court. Appeal has
already been admitted by this Court on 22.4.2009.

3.Considering the allegations against the applicant-
accused as to her involvement in the offence and
considering the argument advanced by the learned counsel
for the applicant Shri Keshwani it appears there is no
authenticate proof adduced before the Trial Court as to
the currency notes being counterfit. According to him,
the allegations made against the appellant are not
sustainable.

4. After hearing both sides, in the opinion of this Court, the applicant – accused no.3 can be released on bail on certain conditions.

5. In the result, the applicant accused no.3 shall be released on the same bail as granted by the Trial Court, but with fresh bail bonds to be executed before the Trial Court.

6. The applicant shall attend D.C.B., C.I.D. Unit VIII, Mumbai on every 1^st day of the month till disposal of the

appeal.

7. Application is disposed of.
