1.The parties have settled the dispute and are
filing the consent terms.
2.The Consent Terms are taken on record and marked
'X' for the purpose of identification.
3.This matter was not appeared on today's Board.
However, the office inadvertently did not place the
matter on Board.
4.The learned Counsel appearing on behalf of the
Plaintiff and Defendant mentioned the matter in the
morning for filing the consent terms. Accordingly,
this Court directed the office to place the matter on
Board for filing the Consent Terms.
5.The Consent Terms are signed by the Plaintiff and
the Defendant and their respective Counsel. Both the

representatives of the Plaintiff and Defendant are
present in the Court. Suit is, accordingly, disposed
of in the aforesaid terms.
6.Refund of Court fees be paid in accordance with
rules.
7.The learned Counsel for the Defendant submitted
that he has paid to the Plaintiff a cheque dated 21st
August, 2009 towards full and final settlement of the
Plaintiff's claim.
8. Certified copy is expedited.
