1.By order dated 2nd November, 2007, the Learned
Single Judge of this Court Justice Shri A.M.
Khanwilkar was pleased to refer the matter to an
arbitrator for determination of disputes under Section
7-B of the Act. The said order was passed only
against the Defendant No.1.

2.In my view, there is no reason why the dispute as
against the Defendant No.2 should not be referred to
the same arbitrator.

3.The dispute as against the Defendant No.2 is also
referred to an arbitrator for determination of the
disputes under section 7-B of the Act. The directions
given by this Court by its order dated 2nd November,
2007 will also to follow as against the Defendant No.2

4. Suit is, accordingly, disposed of. Refund of Court
fees be paid in accordance with rules.
