. Mr. Page on behalf of the respondents
states that the dealership of the Outlet at Digraj
has been awarded to Mrs. Meena Umesh Petkar on
29.11.2007. There is no merit in the contention of
the petitioner that the petitioner ought not to be
evicted from the Digraj Outlet, till another dealer
is appointed. Though the petitioner’s wife may be
the owner of the land neither he nor she has any
right to stay on the land by virtue of such
ownership, since admittedly the site has been given
to Bharat Petroleum Corporation on 1.4.2003 on lease
for a period of 29 years. Undoubtedly, Bharat
Petroleum Corporation has a right to appoint a
dealer in respect of the Digraj Outlet, which they
have, and the petitioner is not entitled to obstruct
such appointment in any way. Petition is therefore
dismissed.
