1. The petition has been filed against the order of the
District Consumer Redressal Forum, Nashik in Darkhast
Proceedings No.78 of 2006 dated 8.2.2008. The
non-bailable warrant has been issued against the
petitioner. The petitioner claims to be the son of the
person against whom an order has been passed by the
District Consumer Redressal Forum. The petitioner’s
father was the judgment debtor. Darkhast proceedings
have been initiated and since the petitioner was not
present before the Court, the Executing Court has issued
the non-bailable warrant.

2. In my view, the following order will meet the ends
of justice:-
O R D E R
(i) The non-bailable warrant is stayed for a
period of two weeks from today.
(ii) The petitioner shall appear before the
District Consumer Redressal Forum, Nashik in
Darkhast proceedings No.78 of 2006 and obtain
appropriate orders for cancelling the
non-bailable warrant.
(iii) In the event the non-bailable warrant is
cancelled by the District Consumer Redressal
Forum, Nashik, the petitioner shall remain
present before the Executing Court on the days
when the matter is fixed for hearing.
3.Writ petition disposed of accordingly.
