Dattakrupa Jeshta Nagrik Mandal Vs the State of Maharashtra and Ors.

Both writ petitions are allowed to be withdrawn with liberty to the Petitioners to approach the Government for hearing and decision of the representation which have already been moved by them. In case representation is not made, present writ petition be treated as representation. The Secretary concerned (Urban Development Department) will hear all the parties including the villagers and decide the controversy raised in the present writ petitions in accordance with law. Secretary is expected to deal with the matter expeditiously and to ensure that he does not jeopardise the rights of any of the parties in these writ petitions. Needless to mention that nominations submitted by the persons in relation to this controversy will be subject to decision of the Secretary. Both the writ petitions are disposed of in above terms with no order as to costs. Election process shall continue. Writ petition No.3030 of 2008 be de-tagged. Same be listed on 10.9.2008.
