Heard Mr. Abhyankar, learned counsel for the petitioner and Mr. Parsodkar, learned counsel appears for the respondent-Board.

Admittedly, in obedience of the interim order passed by this Court, the petitioner's result has been declared by now.

At this stage, Mr. Prasodkar pointed out that the decision taken by the Board is dated 22.5.2008 after the purported enquiry was carried out by the said decision and in addition the performance of his examination held on 10.3.2008 has been cancelled. He, therefore, suggested that so far as the decision dated 22.5.2008 is concerned, the same would be reconsidered in a fresh hearing and by examining the Invigilator concerned.

Hence, by consent, the petition is partly allowed and the decision dated 22.5.2008 is hereby quashed and set aside. The Board will conduct a fresh enquiry so as to examine the Invigilator and, undoubtedly, the petitioner is at liberty to cross-examine the said witness. Fresh enquiry be completed, as expeditiously as possible, and preferably within four weeks. These directions are without prejudice to the rights and contentions of the respective parties.
