The learned counsel appearing for MCI has placed

before us communication dated 22^nd August, 2008 received through courier relating to the subject matter of this petition which is under

the signature of Deputy Secretary of the Medical Council of India wherein it is specifically mentioned that the recognition of MD (Anaesthesia) & DA qualification of Indira Gandhi Medical College, Nagpur will be considered from the 1^st batch of Examination, which, according to them, has been recognised by MCI in the meeting of the P.G. Committee held on 2^nd July, 2008 which has decided as under :-

“The Post Graduate Committee considered the

Council Inspector' s report (May-2008 and June-2008) and decided to recommend that MD (Anaesthesia) and DA qualifications earlier granted by Nagpur University and now by RTM University, Nagpur in respect of students being trained at Indira Gandhi Medical College,

Nagpur be recognized and included in the Ist Schedule to the IMC Act, 1956 restricting the number of admissions to 4 (Four) students for Degree and 2 (two) students for Diploma Course per year prospectively from the academic session 2009-2010 commensurating with the number of available PG teachers.”

The communication dated 22^nd August, 2008 is also taken on record. In view of this, we find that there is no impediment on the part of the Respondent No. 3 to declare the result of the Petitioner. Therefore, we dispose of the petition with a direction that the Respondent No. 3 shall declare the result of the petitioner who has already been admitted to the course and has appeared for examination under the interim orders passed by this Court from time to time.

The petition stands disposed of accordingly.
