1. The impugned orders rejecting the parole
leave application submitted by the petitioners were
already the subject matter of challenge in Criminal
Writ Petition No.1109 of 2007 and the said petition
came to be dismissed by the Division Bench on 27th
July, 2007.
2. Even otherwise, Mr. Patil, learned APP
submits that if the petitioner makes a fresh
application thereby proposing the name of the
surety who is a permanent resident of Mumbai, his
fresh application will be considered on its own
merits.

3. The statement is recorded and the petition
is disposed off with liberty to the petitioner to
file fresh application.
4. This Order be communicated to the
petitioner at the concerned jail.
