1. Heard the learned counsel for the plaintiffs and
the defendants no.1 to 5. The defendants no.6 to 9 are
absent though served. Affidavit of service is taken on
record.
2. This motion is taken out by the plaintiffs for
restoration of Notice of Motion No.1111 of 2008 which

was dismissed in default on 18th June 2008. The motion
is taken out immediately on the next day, i.e. on 19th
June 2008, and the reasons for absence have been
explained in paras 4 and 5 of the affidavit in support
of the motion. Hence, for the reasons mentioned in
paras 4 and 4 of the affidavit in support of the motion,
the order dated 18th June 2008 dismissing the Notice of
Motion No.1111 of 2008 for non-prosecution is recalled
and set aside. This motion is allowed in terms or
prayer (a).
