ORAL ORDER :

Heard Advocate for the parties. Perused the investigation papers. Perused the order passed by the learned Sessions Judge, Margao. Considering the same, though the allegations against the applicants are of serious nature and the photographs produced before me also show the burnt house property, taking into consideration all the materials collected so far by the investigating agency and the time which was available to the investigating agency for conducting the investigation, I do no find any justification for detaining the applicants any more in the custody. The learned Public Prosecutor for the respondent stated that the investigating agency apprehends that the applicants may, in both the cases, influence the witnesses in the Village and may cause obstruction in the fair investigation. Certainly, while granting bail, conditions can be imposed and necessary precautions can be taken to avoid interference of the applicants in the investigation.

Hence, both the applications for bail are allowed, subject to the conditions :

(i) Each of the applicants shall execute personal bond in the sum of

Rs.25,000/- with one surety in the like amount to the satisfaction of the

J.M.F.C. Margao;

(ii) The applicants shall not enter the Village Dramapur-Salcete for a period of 5 days from the date of their release;

(iii) The applicants shall not interfere, in any manner, in the investigation being carried out nor shall try to influence any of the witnesses and shall extend necessary co-operation to the investigating officer in completing the investigation as early as possible.

With these directions, both the bail applications are disposed of.
