 Heard learned counsel for the parties.

 In both these petitions, the petitioners
 have impugned the orders, both dated
 23.11.2006, passed on two different
 applications; first being the application
 under Order VI Rule 17 of the Code of Civil
 Procedure filed by the respondents and other
 being the application under Order VII Rule 11
 filed by the petitioners. Mr.Joshi, learned
 counsel for the petitioners, submits that he
 has instructions not to press these petitions
 and prays for liberty to the petitioners to

 challenge both these orders in appeal if the
 suit filed by the respondents-plaintiffs is
 decreed. Mr Soni, learned counsel for the
 respondents, has no objection for granting
 such liberty. Both, the writ petition and
 the civil revision application, are disposed
 of as not pressed with liberty as prayed.
 All contentions of the parties are kept open.
 It is open for the petitioners to file
 additional written statement, if they so
 desire, within four weeks from today.
