1. The civil application is taken up for
hearing today. The submission of the learned
counsel for the applicant is that the applicant
should be permitted to withdraw the remaining
amount of Rs.2,00,000/- which has been deposited by
the respondent as per the order of this Court dated
16-10-2008.
2. It is not disputed that the said amount has
been deposited pursuant to the order passed by the
Family Court. The amount pertains to permanent
alimony. In this view of the matter, the applicant
is permitted to withdraw the aforesaid amount of
Rs.2,00,000/-. Such withdrawal shall be subject to
final outcome in the Family Court Appeal.
