By order dated 5.7.2007 this Court had directed the appellant/applicant to deposit in this court a sum equal to 50 % of the back wages and this was the precondition for stay so far as back wages were concerned. According to the respondent, the appellant has failed to pay back wages.

In these circumstances, needless to say that the stay order does not operate and the respondent is free to take action against the

appellant. As such, no order is required to be passed on this application. The same is, therefore, disposed of.
