The incident is said to have taken place on 4.6.2007. The eye witness alleged to have seen the incident appears to have come forward only at the end of November, 2007. If the eye witness had seen the incident there was no reason for him to not to report to Police Station or disclose the incident seen by him. At least in so far as present applicant is concerned, there is no specific evidence about Guddu and the weapon used and the actual role of assault. Hence, prima facie case is made out. The applicant be released on bail upon executing P.R. bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two solvent sureties in like amount. Criminal Application stands disposed of.
