withdraw this appeal with liberty to file the appeal
before the Sessions Court. He submits that since the
judgment and order was passed by the Assistant Judge,
the appeal would lie before the Sessions court and not
the High Court.
2. The appeal, therefore, is allowed to be
withdrawn with liberty to file before the District
Court.
3. The appeal is, accordingly, disposed of.
