petition is rendered infructuous because Marriage
Petition No.363 of 2003 has already been decided by
the trial Court and therefore, the order passed at
the interim stage would not survive.
2.He seeks liberty regarding prayer clause (b)
of the petition in as much as the order passed on
15th July, 2006 is capable of being challenged by

filing Criminal Revision Application.
3.This request is not opposed by the other
side.
4.Petition is disposed off as infructuous and
by reserving liberty to the petitioner to challenge
the final order in the Marriage Proceedings as also
in Miscellaneous Application No.53 of 2003 in
accordance with law. No order as to costs.
