We have heard learned counsel appearing for the
parties at some length. We are of the considered view that looking to the prayers made in this writ petition and the factual
controversy raised by the parties, the present writ petition essentially has to be referred to the Committee constituted by the Government in furtherance to the Full Bench Judgment of this
Court dated 1st November, 2007 in Writ Petition No.1326 of 2007
(Tulsiwadi Navnirman Co-op. Housing Society Limited & Another V/s. State of Maharashtra & Others) and other connected writ petitions.
Thus, we direct the petitioner to approach the Committee within two weeks from today and the Committee shall proceed and decide the matter in accordance with law after hearing all the affecting parties. We do hope that the Committee do so expeditiously.
