1. Shri Sadavarte states that the amount of
surcharge which is the only amount which is
remaining outstanding has been quantified by the
respondent no.1 Bank at Rs.86,521/- Shri
Sadavarte and Shri Desai do not dispute this
figure and once this amount is tendered, the
first respondent Bank will issue no due
certificate in favour of the petitioners in each
of these petitions. Needless to state that the
amount will have to be paid to the first
respondent bank and the first respondent Bank
would thereafter deposit the said sum or part
thereof in the Government treasury. Similarly,
the first respondent Bank is at liberty to
withdraw the sums which have already been
deposited with the joint Registrar by the
petitioners. At the request of the petitioners,
two months time is granted to them to pay the
amount quantified above.
