CORAM: S. B. MHASE &

DATE: DECEMBER 12, 2007.
P.C.
1. The petitioner is under-trial
prisoner in a rape case. He has been charge
sheeted under section 363, 302, 376(A) of
the IPC for committing rape on a minor girl
of 14 years on 19/4/2006. Charge-sheet has
already been filed. The grievance of the
petitioner is that the police has wrongly
roped the petitioner into this crime and
are spoiling the life of the petitioner.
Therefore the petitioner is seeking CBI
inquiry as against the police station. The
application itself is misconceived. It is
open for the petitioner to submit in trial
as to how he has been wrongly implicated by
the police. No case is made out for
directing the CBI inquiry. Application is
rejected.
