1. The Investigating Officer is present before
this court. He makes a statement that the State desires
to file "C" Summary report which means that the case is
neither true nor false. We have also perused the order
passed by this court on 15th October, 2007 and more
specifically the facts stated in paragraph 9 of the said
order. Therefore, we find that the grievance of the
petitioners stands redressed.
2. The complainant is present. On the earlier
occasion, the complainant was not present and,
: 2 :
therefore, bailable warrant was issued. However, today
he is present and in view of the fact that the Petition
is being disposed of, the complainant is also relieved.
The complainant has also made a statement that he
desires to withdraw the Criminal Application No.330
filed by him in this Writ Petition. Leave to withdraw
the said Criminal Application is hereby granted.
3. We, accordingly, dispose of the Criminal Writ
Petition No.1752 of 2007.
