The challenge in this Petition under Article 226 of the Constitution is to the notification issued by the Government on 2^nd

February, 2007. It is not necessary for us to record in detail the

facts which give rise to the present Petition in view of the action which we propose to adopt.

Having heard the learned counsel appearing for the

parties for quite some time as well as with their consent we dispose of this Petition with the direction that the Respondent State would

¶20

hear the Petitioners who are at liberty to file objections to the notification, if any, within two weeks from today. If such objections are filed, the State Government may hear it in a representative capacity or through counsel and then pass appropriate orders in accordance with law within six weeks thereafter.

This order will not be treated as a mandamus or any

other direction for altering the status of the notification during the hearing.

¶23

The Petition is disposed of, leaving the parties to bear

¶24

their own costs.
