1.Heard Advocate for the Applicant. None
appears for the Respondent though the office noting
shows that notice is duly served. The
Applicant-Plaintiff has applied for temporary
injunction during the pendency of the second
Appeal. By order dated 06th July, 1998, temporary
injunction was granted by the trial Court and the
said order of temporary injunction was confirmed in
an Appeal. However, there is nothing on record to
show that temporary injunction was operating during
pendency of Civil Appeal No.49 of 2005.

2.The Second Appeal has been admitted for
final hearing. Considering the aforesaid aspects
and the facts of the case, parties will have to

possession. Hence, Civil Application is disposed
of by directing that the parties will maintain
status-quo as of today as regards possession of the
suit property till the final disposal of the Second
