2. Mr.Mahadik, learned counsel for the
applicants submits that the applicants will be
satisfied if the appeal itself is placed for
hearing. He submits that the execution is
almost concluded and it has reached the stage of
possession. Keeping that in view and
considering that the decree impugned in the
appeal is of partition of the joint family
properties, office is directed to place second
appeal No.435 of 1998 for final hearing on 3rd
December, 2007. If the appeal is not heard
within four months from today liberty to the
applicants to file fresh appilcation for similar
reliefs. Civil application is disposed of.
