. The State is challenging the order of acquittal
passed by the Judicial Magistrate, First Class, Kagal,
Dist.Kolhapur, dated 22nd December, 2005 whereby the
accused was acquitted of the offence punishable under
Section 52 read with Section 42 of the Maharashtra
Regional and Town Planning Act.
. I have perused the impugned order and the notes
of evidence. There is no perversity in the finding
recorded by the trial Court. No case is made out for
grant of leave.
. Leave is refused.
