1. Heard Advocates for the parties. The
prayer in this Criminal application is for
relaxation of condition of attendance
which is a part of the order dated 27th
November 2006 by which the Applicant was
ordered to be enlarged on bail. The
condition requires the applicant to report
to Juhu Police Station on every first and
third Saturday of every calendar month
till the disposal of the Appeal. The
learned A.P.P. submitted a report which
discloses that from March 2007 the
Applicant has not reported to the
concerned police station. The learned

Advocate for the Applicant states that due
to genuine difficulty the Applicant could
not comply with the condition of
attendance.

2. As the Applicant has not complied with
the condition imposed in the order dated
27th November 2006 for last more than four
months, the prayer for relaxation of the
condition cannot be considered. Such
payer can be considered only after the
Applicant abides by the said condition for
reasonably long time.

3. At this stage, the learned Advocate
for the Applicant seeks permission to
withdraw this application.

4. The Application cannot be allowed to
be withdrawn and the same will have to be
dismissed. Application is accordingly
dismissed.
