2. The learned Advocate for the applicant
submits that the applicant has a very good case
on merit and therefore Criminal Appeal No.86 of
2007, the hearing thereof may be expedited and
may be fixed for disposal as early as possible.
The learned Advocate for the applicant further
states that if appeal is fixed for early
hearing, the appellant would not press for the

present application. On perusal of the
application and the copies of the evidence
produced on record, we do find that the Appeal
needs to be heard expeditiously. Criminal
Appeal No.86 of 2007 is accordingly directed to
be placed for hearing peremptorily on 15th
January, 2008. The appellant is permitted to
furnish private paper-book. Infact, the
paper-book is ready in the form of memorandum of
appeal with annexures and the same shall be
treated as paper-book unless the prosecution
wants to place on record any additional material
from the records before the trial Court, which
if they so desired may place on record on or
before 30th November, 2007.
3. In the circumstances, while granting
peremptory hearing of Criminal Appeal No.86 of
2007 on 15th January, 2008, the present
application is allowed to be withdrawn and is
disposed of as such.
