2. The learned counsel for the respondent on behalf
of the respondent makes a statement that pending the
final disposal of the Short Cause Suit No.3350 of 2005,
the respondent/defendant shall not create any third
party interest in the suit flat no.501 situated at the
5th floor of Pracheeta Building. The statement is
accepted. In view of this statement made by the
respondent, appeal stands disposed off.
3. The learned trial Court shall try to expedite
and dispose off the suit as early as possible.
