. By the order dated 17th April 1984, this Court decreed the suit in terms of prayer Clause (a) and costs of Rs. 1,025/-. On defendant’s motion to set aside the exparte decree, by an order dated 6th May 1984 passed in Notice of Motion No.1327 of 1984, this Court (Coram : Pendse, J.) set aside the exparte decree and restored the suit to the file, subject to the condition that defendant shall deposit in the Court, a sum of Rs. 25,000/within four weeks. By the said order, Court further directed that if the amount was not

deposited,		the	Motion	would	stand dismissed,
without	refere	nce	to the	Court.	Certificate of
non de	posit	is	produced.	The	defendant has not
deposited	the		amount, and	ther	efore, the motion
for	restora	tion,	by reas	on o	f self operating
