Heard learned counsel for the parties.
A report dated 6th December, 2006 has been
submitted by the Director General of Police, ACB, M.S. Mumbai in which it has been pointed out that the officers of the Commission have not been cooperating with the investigation. An affidavit in reply has been filed by the Member Secretary of the Commission and the allegations in the report have been controverted and counter allegations against the investigating agency have been levelled. We are indeed surprised that two agencies of the Government are at the loggerheads in an investigation which is essential in public interest and calls for
cooperation between all agencies of the Government. We are accordingly of the opinion that in order to avoid further controversy, the Director General of Police, ACB will submit a
list in writing of the documents and witnesses he wishes to examine and the Commission will act promptly on any such request. We also direct that the investigation will proceed in accordance with the directions issued by this Court in its order dated 29th September 2006 and that the matter will be concluded as soon as possible.
Writ petition is disposed of with the above directions.
