.Heard.

2.We find from the order dated 30th January,
2006 passed by the Supreme Court that the respondent
No.1 has to pay the amount of maintenance to the
appellant at the rate directed by the trial court
(Family Court). The counsel agree that as per the
direction of the Family Court the first respondent has
to pay an amount of Rs.3,000/- per month towards the
maintenance of the applicant.

3.Mr. Uday Warunjikar, counsel for the first
respondent submits that the maintenance amount at the
rate of Rs.3,000/- per month from the month of June 2005
upto July 2006 (in all Rs.42,000/-) has been deposited
by the first respondent with the trial court (Family
Court).

4.The respondent No.1 is personally present and
he undertakes that the maintenance amount from the month
of August 2006 shall be deposited by him with the trial
court (Family Court) on or before 7th day of each
English calendar month.

5.Having considered the matter, we pass the
following order:

(1)The applicant (wife) is permitted to
withdraw the amount of Rs.42,000/- deposited
by the first respondent with the trial court
(Family Court) towards maintenance for the
period from June 2005 to July 2006, if not
withdrawn so far.

(2)We accept the undertaking of the first
respondent that maintenance from the month of

August 2006 and subsequent months shall be
deposited by him at the rate of Rs.3,000/- per
month with the trial court (Family Court) on
or before the 7th day of each English calendar
month. The applicant shall be at liberty to
withdraw the said amount from the Family
Court.
