1. Counsel for respondent no.2 submits that ordinarily,
the delay being of 99 days, he would not have opposed the
prayer for condoantion of delay. However, according to
him, the application as filed is bereft of any material
facts which could persuade this Court to condone the
delay. In response to this submission, the counsel for
the applicant accepts that the facts stated in the
-: 2 :-
application will have to be provided with better
particulars. He prays for one week’s time to file further
affidavit.
2. Stand over to 28.4.2006. If further affidavit is not
filed by the applicant on or before 25.4.2006, the
application will stand dismissed for non-prosecution.
