the present case the defence was
that the death was suicidal and
that deceased was fallen in the
well while she was cutting the
grass. There is also no clear
finding that death was suicidal.
The maximum sentence is of 7
years. The applicant was on
bail in the trial Court. There
was no allegation of abusing of
bail. In the circumstances,
pending the hearing and final

disposal of the appeal, the
applicant may be released on the
same bail as in the trial Court
subject to his furnishing fresh
bond. Application stands
