2. The learned counsel does not dispute that the
judgment of this court in Municipal Corporation of
Brihanmumbai v/s. Dalamal Tower Premises Co-operative
Society Ltd., 2006 (3) Bom.C.R. 557, concludes the
issue raised in the Appeal. In this view of the matter,
the learned single Judge cannot be said to have erred in
dismissing the writ petition.
