1.	The	suit has	been	instituted by	the Board	of
Trustees	of	the	Port	of Mum	bai for	the	recovery of	the
deficit	of	wharf	age,	demurrage	and	other	charges.	The
suit is	filed	for		the reco	very	of	a total sum	of
Rs.4,01,237	.29	together		with	further		interest on	the
principal	sum.		The	Defenda	nts	have	not filed	their
written	statement	in	the	Suit	which	has	been instituted	in
1988.	Acco	rdingly,		by an	order	dated	25th August	2006,

the suit was directed to proceed against the Defendant for

want of written statement.

of	Rs.3,84,395.2	9 fr	om	the	date	of	the	instit	ution	of	the

suit till payment or realisation and to the costs of the

suit.
