1. The learned A.P.P., on instructions
states that no order as regards the
show cause notice issued to the
petitioner on 27.4.2004 and the reply
filed by her on 15.5.2004, has been
passed and in that regard she is
required to appear either herself or
through her authorized representative
on 6.4.2005 at 3.00 p.m. in the office
of the Commissioner of Police, Crawford
Market, Mumbai. He further submits
that, on hearing the petitioner on the
said date, the respondents will pass
the appropriate order in accordance
with the provisions of law within four
weeks therefrom. We accept the said
statement and in view of the same, the
learned advocate for the petitioner
states that necessary arrangements will
be made for appearance of the
petitioner or her representative in the
office of the Commissioner of Police,
Crawford Market, Mumbai on 6.4.2005 at
around 3.00 p.m. and in view of the
assurance given by the respondents, the
petitioner will be heard in the matter.
Under the circumstances, the learned
advocate for the petitioner craves
leave to withdraw the petition and he
is allowed to withdraw the petition
while accepting the said statement made
on behalf of the respondents. Needless
to say that this Court has not
expressed any opinion on any of the
issues raised and those issues are kept
open. Petition accordingly stands
disposed of.
