1. Heard the counsel for the parties.

¶10

2.This is second bail application preferred
before this court. First bail application was filed
before filing of the chargesheet, which was withdrawn
with liberty to the applicant.

3.The main ground on which this application is
filed is that co-accused has been already released by
the lower court and the applicant ought to be released
on parity.

4.The learned APP fairly accepts on instructions
that the applicant is also entitled to be released on
bail on the ground of parity as in the case of Ravi
Shankar Ramsis Prasad. Accordingly, application
succeeds on following terms.

(a)The applicant is directed to be
released on bail in connection with C.R.No.29
of 2004, registered with Mahabaleshwar Police
Station, Dist. Satara on executing personal
bonds in the sum of Rs.30,000/- with one or
two local sureties in the like amount.

(b)The applicant can avail cash
bail to be replaced by appropriate surety
within 10 days from the date of his release.

(c)The applicantshall not

influence the prosecution witness or tamper
with the prosecution evidence in any manner
whatsoever.

(d)The applicant shall report to
Mira Road Police Station within whose

jurisdiction, applicant is presently residing,
once in a month on first Saturday of every

English Calender Month between 10 a.m. to 2
p.m. during pendency of the trial.

(f)The applicant shall extend full
co-operation for early disposal of the trial.
If the trial court is of the opinion that he
is responsible for delay in trial that fact be
recorded in the Roznama, which can be a ground
for cancellation of bail.
